1. Acceptance of Terms

These Terms and Conditions and End User License Agreement ("Terms") constitute a legally binding agreement between you ("User", "Producer", or "Licensee") and 8Bit Audio ("8Bit Audio", "we", "us", or "our").

By visiting our website, creating an 8Bit Studio ID, claiming a free Octave license, or downloading our audio software (including standalone binaries and VST3/AU/AAX plugins), you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

2. Software License & Royalty-Free Usage

Subject to your compliance with these Terms, 8Bit Audio grants you a worldwide, non-exclusive, non-transferable, revocable license to:

• Install and operate Octave Sampler on your personal and studio workstations.
• Load, play, modulate, and process the included 6 factory multi-sample soundbanks (.oisf format) within compatible digital audio workstations (DAWs) including Ableton Live, FL Studio, Logic Pro, Cubase, Studio One, Reaper, and Bitwig Studio.
• Royalty-Free Commercial Music Rights: Any musical compositions, beats, film scores, game audio, soundtracks, or commercial recordings created by you using Octave Sampler and its sound libraries are 100% royalty-free. You own your musical creations and do not owe 8Bit Audio any mechanical or performance royalties.

3. Restrictions & Prohibited Conduct

You agree not to engage in any of the following unauthorized activities:

• Raw Sample Redistribution: You may NOT decompile, extract raw audio sample files (.wav, .oisf), or repackage them as standalone sample packs, sound libraries, or virtual instruments for resale or free distribution.
• Reverse Engineering: You may NOT reverse engineer, disassemble, decompile, or attempt to derive source code from Octave Sampler binaries or DSP algorithms.
• License Tampering: You may NOT bypass, disable, crack, or circumvent the software licensing key verification system.
• Malicious Code: You may NOT upload or inject malicious scripts, viruses, or disruptive code into our web app, APIs, or community services.

4. 8Bit Studio ID & Account Responsibilities

When creating an account or claiming a license, you must provide accurate, current, and complete information. You are solely responsible for:

• Maintaining the confidentiality of your login credentials and license keys.
• All activities that occur under your 8Bit Studio ID account.
• Promptly notifying us at 8bitaudioo@gmail.com or via our support hotline at +91 9395987493 if you suspect any unauthorized access.

5. Intellectual Property Rights

The Octave Sampler engine, Direct-From-Disk (DFD) streaming architecture, DSP filter algorithms, 3D orbital interface designs, trademarks, logos, and sound library master recordings are the exclusive intellectual property of 8Bit Audio and its licensors. All rights not expressly granted to you are reserved.

6. Disclaimer of Warranties ("As-Is")

OCTAVE SAMPLER AND ALL DIGITAL SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AUDIO ACCURACY, OR SYSTEM COMPATIBILITY.

While we strive for flawless performance across all DAWs and operating systems, 8Bit Audio does not guarantee that the software will be completely error-free, uninterrupted, or compatible with all third-party audio hardware or legacy operating system configurations.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 8BIT AUDIO, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, DAW PROJECT CORRUPTION, HARDWARE DAMAGE, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SOFTWARE.

8. Termination

We reserve the right to suspend or terminate your license or account immediately, without prior notice, if you breach any provision of these Terms (specifically including raw audio extraction or unauthorized software cracking). Upon termination, your right to use the software ceases immediately, though you may continue to commercialize music already created with the software prior to termination.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Pune, Maharashtra, India, and the parties hereby consent to personal jurisdiction and venue therein.

10. Modifications to These Terms

We may revise these Terms from time to time to reflect updates in our software, legal requirements, or pricing tiers. We will post the revised version with an updated "Effective Date" at this URL. Continued use of the software after such changes constitutes your acceptance of the updated terms.
